Prayagraj. Allahabad High Court has canceled the result of PCS Pre 2021 examination to the extent that the benefit of five percent reservation can be given to the ex-servicemen. The court has directed the Public Service Commission, Uttar Pradesh to issue fresh results giving the benefit of five percent reservation to ex-servicemen and issue admit cards for the main examination to them within a month of the result. Justice Sangeeta Chandra has given this order while hearing the petition of Satish Chand Shukla and others.
It was said in the petition that after the Kargil war in 1999, the state government had made changes in the reservation given to ex-servicemen and made arrangements to give five reservations, but in this group A and B were removed. A petition was filed in the High Court regarding this, in which the state government filed a reply and said that the government is considering the issue. After that, the state government made another amendment in the Reservation Act and brought Group B service under the purview of reservation and its notification was published in the gazette on 10 March 2021. During this, PCS 2021 advertisement was released on 5 February 2021. The last date for online application was March 5, 2021, which was later extended to March 17, 2021. The petitioners said that despite the publication of the notification before the last date of application, the Public Service Commission refused to give the benefit of reservation to the ex-servicemen.
The court said that when the 2021 amendment was notified, the online form filling portal was open till March 17, 2021. In such a situation, had the Commission been cautious, it could have given the benefit of reservation to Group B and C as it was published in the gazette on 30 March 2021. The actual selection of the exam started from 23 March 2022 when the main exam was conducted. The court has directed to issue a fresh result while canceling the result of preliminary examination of PCS 2021 in respect of ex-servicemen.
Commission’s ongoing interview
These days the PCS 2021 interview is going on in the Public Service Commission. The interview of successful candidates in the main examination started on July 21, which is to continue till August 5. Against 623 posts, 1285 candidates have been called for interview. After this order of the High Court, no official statement has been issued by the Commission. However, sources in the commission say that a petition can be filed against this order in a double bench.
