Uttarakhand HC stays Lower PCS recruitment process: Wednesday, the Uttarakhand high court (HC) issued a stay on the Lower Provincial Civil Services (PCS) recruitment process to cover 190 positions and ordered the state government to respond within three weeks. The court’s decision was the result of a petition challenging the commission’s decision to relinquish six allocated positions for candidates with disabilities. The next hearing regarding this issue is scheduled for August 9.

Uttarakhand HC stays Lower PCS recruitment process amid reservation challenge

In August 2021, the Uttarakhand Public Service Commission (UKPSC) announced the availability of 190 Lower PCS positions. In December 2021, the preliminary examination was administered, followed by the final examination on August 22, 2022. The final examination’s successful candidates were scheduled to begin interviews on July 24.

Vinod Singh, the petitioner, has asked the court to reverse the commission’s decision to release six reserved positions for Divyang (persons with disabilities). According to the petitioner, “this action by the commission is unconstitutional because the UKPSC is merely an agency and does not have the authority to hand over previously designated posts to the government.”

In addition, the petitioner argued that “if the recruitment process continues without taking into account the reservation for candidates with disabilities, it will cause them irreparable harm because they will be overage for the next recruitment process.”

The court ruled that the recruitment process must be halted until the government submits its response affidavit.
