H1B Visa Renewal Made Easy: During his highly anticipated address to the Indian diaspora at the Ronald Reagan Centre in Washington, Prime Minister Narendra Modi announced that Indian Americans no longer need to depart the country to renew their H-1B visas.

“It has been determined that one will no longer be required to leave the United States in order to renew an H1B visa. A pilot project will shortly be initiated in this regard. While addressing the Indian diaspora at the Ronald Reagan Centre in Washington, Modi stated that this will benefit tens of thousands of IT workers.

The significant decision will benefit thousands of Indian professionals operating in the United States, as they will no longer have to travel overseas to renew their H1B visas.

The U.S. Department of State recently decided to initiate a pilot programme later this year to adjudicate domestic renewals of certain petition-based temporary work visas.

This initiative will involve Indian nationals, with the intention of implementing it for a larger group of H1B and L visa holders in 2024. The programme will be expanded to include additional eligible categories.

US President Joe Biden and Indian Prime Minister Narendra Modi emphasised that the mobility of professionals, qualified workers, students, investors, and business travellers plays a crucial role in enhancing bilateral economic and technological cooperation.

“While acknowledging the significant measures taken to improve the processing of visa applications, they emphasised the urgent need to further accelerate this process. The leaders also instructed officials to identify additional mechanisms to facilitate business, tourism, and professional and technical exchanges between the two nations, according to the joint statement.

The Indian diaspora greeted this announcement by the Prime Minister with a standing ovation and a cordial welcome.

H1B Visa Renewal Made Easy: What Is an H-1B Visa?

The validity period for these visas is three years. If H-1B visa holders intend to travel outside the United States and re-enter, they must have their passports stamped with the new expiration dates upon renewal. Currently, this visa cannot be re-stamped within the United States.

Prior to 2004, H-1B visa holders could have renewed their credentials within the United States. However, this policy altered in 2004, making it mandatory for H-1B visa holders to renew their visas outside the United States. This modification caused considerable inconvenience, particularly for those with lengthy visa renewal wait times.

H1B Visa Extension

The H1B visa provides its bearers with numerous benefits. Due to the lengthy process of finding an employer, being chosen in a lottery, and obtaining approval, it is extremely valuable.

Typically, a foreign national is granted an initial three-year stay in H-1B status. As the expiration date approaches, they may submit an application to extend their visa for a maximum of six years.

Conditions for H-1B Visa Extensions Past 6 Years

Some H-1B visa holders with a Labour Certification Application that has been outstanding for more than 365 days or 1 year may have the option to extend their visa beyond the 6-year limit in increments of 1 year. This can be done until a final judgement is made on their case for permanent residence based on employment. Notably, the 7th-year extension is only available to those applying for green cards through the employment-based category; it does not apply to those with unresolved family-based petitions.

Approval of a visa through the standard application procedure requires more than three months. Depending on whether RFEs are issued, H1B extension processing will take at least 4 weeks to 5+ months. The Texas service centre has the quickest processing periods as of September 2023.

Requests for extensions are comparable to the initial H-1B petition packet. The proposal may be submitted up to six months before the H-1B status expires. The employer is responsible for filing Form I-129 on behalf of the employee and submitting it with all required documents.

  • The fee for amending Public Law 114-113, if applicable, is $4,000
  • The ACWIA fee ranges from $750 to $1,500.
