UPSSSC Excise Constable Recruitment: High Court refuses to interfere in women selection matter

The court said that the classification of men and women in physical efficiency is not arbitrary. The allegation of discrimination between men and women is baseless, which cannot be accepted.

UPSSSC Excise Constable Bharti: The Allahabad High Court has refused to interfere in the matter of women being selected in Excise Constable Recruitment for more than the reserved posts. The court said that the classification of men and women in physical efficiency is not arbitrary. The allegation of discrimination between men and women is baseless, which cannot be accepted.

Justice Saurabh Shyam Shamsheri has given this order while dismissing the petitions of Pramod Kumar Singh and Siddharth Pandey. The court said that women’s power will build a powerful society. Women have outperformed the failed men in merit by earning a large number of successes. Men will be ahead, this is not acceptable in the 21st century. The court also said that those who fail to challenge the selection process cannot challenge the selection process. On this ground the petition is not maintainable.

According to the facts of the case, the Uttar Pradesh Subordinate Services Selection Commission took out the recruitment of Group C Excise Constables. In which there were posts of 203 general, 109 OBC, 85 SC, eight-eight ST and freedom fighter dependent, 20 ex-servicemen and 81 women. Its result was declared on 17 August 2021. In which 143 women were selected. In the selection, the unsuccessful petitioners said that 81 seats were reserved for women, but 143 women were selected. This is an arbitrary and discriminatory act against male candidates. The petitioners said that there has been discrimination in the standard of male and female in the physical efficiency test. Questions were raised on the maintainability of the petition on behalf of the government. Considering the physical ability of men and women, the court considered both as separate categories and said that it is not wrong to vary the selection criteria. The grounds taken in the petition are not acceptable.
