Flight Delay Compensation Explained: When Can Passengers Get a Refund or Cash Payment?

Flight Delay Compensation Requirement: Getting stuck at the airport because of a delayed flight can be frustrating, but it doesn’t automatically mean you’ll receive money from the airline. The rules depend on the route, the reason for the delay, and how much your travel plans are affected. In the U.S. airlines usually aren’t required to pay passengers simply because a flight is running late. But if the delay is long enough and you choose not to travel, you may be eligible for a refund instead.

Under US rules, a delay is considered significant when a domestic passenger is expected to arrive at least three hours late. For an international journey to or from the United States, the limit is six hours. Passengers must refuse the delayed flight, replacement flight, travel credit or other offer to receive the refund.

A refund gives back the price of the unused ticket. It normally applies when the passenger chooses not to travel after a cancellation or major schedule change. Compensation is extra money paid because the disruption caused serious trouble. US law generally does not guarantee this extra payment for ordinary domestic delays.

Some airlines may still provide meals, hotel rooms, transport or travel vouchers when the delay was caused by something within their control. This could include crew shortages, maintenance problems or baggage-loading issues. These benefits depend on the promises made by each airline.

Passengers who accept the delayed flight or another flight offered by the airline normally lose their right to a full ticket refund under US rules. Airlines must issue qualifying refunds automatically. Credit card payments should generally be returned within seven business days, while other payment methods may take up to 20 calendar days.

European Flights may Offer Stronger Rights

Passengers can have stronger protection when European Union rules apply. These rules cover flights leaving an EU country, including flights operated by non-European airlines. They can also cover flights arriving in the EU from another country when a European airline operates the service.

A passenger who reaches the final destination at least three hours late may qualify for compensation when the delay was the airline’s responsibility. Payments can range from €250 to €600 depending on the flight distance and total arrival delay. On some long-distance flights, the full €600 amount applies when the arrival delay reaches four hours.

Compensation may not be available when extraordinary events caused the disruption. These can include dangerous weather, air-traffic restrictions or serious security problems that the airline could not reasonably avoid.

How to make a Claim?

Passengers should keep their boarding pass, booking confirmation and all messages received from the airline. They should ask the airline for the reason behind the delay and take a photograph of the airport departure board when possible. It’s also important to record the real arrival time and save receipts for food, transport or hotel stays. These documents can help prove the length and cost of the disruption.

A claim can normally be sent through the airline’s website or customer service department. Include the flight number, travel date, booking details, delay length and copies of any evidence. The most important step is to first check whether the passenger is seeking a refund for an unused journey or extra compensation for the delay itself, as the rules for each are different.
