Understanding RERA Haryana: Rules, Regulations, and Homebuyer Protections

The Indian parliament passed the RERA and HRERA, regulating the real estate industry in Haryana, with states enacting their own versions to safeguard buyer interests.

What is RERA? By regulating the real estate industry, the Indian parliament passed the Real Estate (Regulation and Development) Act, 2016, which safeguards the interests of home buyers. States, including Haryana, began enacting their own versions of the Real Estate (Regulation and Development) Act 2016 (HRERA) after Parliament passed the central version, maintaining the fundamentals established in the Union version.

Haryana’s RERA for homebuyers

Panchkula and Gurugram are under the independent authority of RERA Haryana. What’s the best way to search registered projects on RERA Haryana?

  • Click on the ‘Project Registration’ tab for ‘Search projects’ on the HRERA homepage www.haryanarera.gov.in.

  • You can choose between RERA Gurgaon, RERA Panchkula, or the Haryana Real Estate Advisory Tribunal.

  • Search for projects under Haryana’s RERA Act by entering the captcha.

  • Put the project number and year in.

  • Search for projects by entering the captcha.

HRERA has 3,334 registered agents. On the RERA Haryana website, you can get details about their district, registration certificate, etc. Buyers should take advantage of such details.

RERA Haryana: How do I file a complaint?

Do you have a complaint about a project, builder, or agent? Here’s how to file a complaint. Make sure you read the Haryana RERA rules before filing a complaint.

  • You can register a complaint on RERA Haryana’s homepage.

  • Fill out the HRERA form and follow the steps.

  • You’ll get an online complaint number once you fill out the HRERA form. Keep it handy for later.

  • You can pay on the RERA Haryana website. There’s a fee of Rs 1,000 per complaint right now. There’s also a fee of Rs 10 per annexure. Demand drafts can be made out to Haryana Real Estate Regulatory Authority.

  • Print the acknowledgment page after HRERA payment.

  • You’ll also need to print out the Performa B on HRERA. Here’s the detailed form. Make five copies.

  • With your complaint, attach a copy of the RERA Haryana certificate stating that a self-signed copy was sent to the respondent directly.

  • Hand or post three copies of the HRERA set, comprised of the Complaint Registration Form and Annexure, Demand Draft of Fee Paid, Detailed Typed Complaint and Self-declared and signed Certificate, at the office of the Authority.

How do I search for complaints under RERA Haryana?

On the HRERA portal, click on ‘Search complaint’ under complaint registration to see the status of your complaint.

Enter the case number, the case year, and captcha, then hit ‘search’.

How do I register a project under RERA Haryana?

Here’s how developers can register on RERA Haryana’s website.

  • To register your project, click on the Project Registration tab on the RERA Haryana portal.

  • On RERA Haryana, you’ll need to include basic details about the project and the applicant.

  • Save each page and keep going.

  • Fill out Form A on RERA Haryana and pay the fee.

  • You can also preview it. Once you’re sure the details are right, submit it. You’ll get a temporary project ID.

  • Keep a few copies of this HRERA registration form handy. We’ll submit three of them.

  • Make sure you have all the documents you need: bank drafts, licences, approvals, renewal letters, ownership documents, bilateral agreement with DTCP, copy of LC-IV, power of attorney, zoning plan, building approvals, etc.

  • Number all your documents and prepare them according to Haryana RERA

  • Submit your Haryana RERA documents online. The authority should get a hard copy.

  • The project will be live on RERA Haryana once a receipt is generated.

RERA Haryana: How to register as an agent?

Agents are required to provide information about their company and its type, such as whether it is a partnership, a society, or a sole proprietorship. You’ll also need to provide your registered address. Online registration requires a PAN card, proof of address, photographs, contact details, particulars of registration, byelaws, etc.

Banks get a warning from RERA Haryana

On February 12, 2024, RERA Haryana sent notices to banks about illegal withdrawals from ESCROW accounts. If found guilty, both banks and developers will be penalized.

HRERA sets upper limit for advance payment of unit to maximum 10%

Haryana Real Estate Regulatory Authority (HRERA), Gurugram limits advance payments for units to 10%. By Section 13(1) of the RERA Act, 2016 and Rule 8(1) of the Haryana Real Estate (Regulation and Development) Rules, 2017, the authority has issued orders.

Under the new order, no promoter can accept more than 10% of the cost of an apartment, plot, or building without a written agreement for the sale. According to the Act, the sale agreement should specify details about the project, payment details, possession date, and other relevant info.
